Articles of Incorporation
Also referred to as a Certificate of Incorporation or charter. The articles of incorporation is the primary legal document of a corporation; they serve as a corporation’s constitution. The articles are filed with the state government to begin corporate existence and contain basic information on the corporation as required by state law.

Bylaws
A legal document stating certain self-imposed rules adopted for the regulation of an associations own actions. Since it is a required element when forming a homeowners association, bylaws are a form of agreement or contract between the board of directors and the homeowners in which the board of directors will conduct itself in a certain way.

Covenants, Conditions and Restrictions (CC&R’s) Part 1 of 2
A series of regulations set up by neighborhoods or housing developments that govern various construction features as well as control the nature and character of a property development for the benefit of current and future owners. The limitations placed on the use and enjoyment of real property are intended to maintain a certain look within the neighborhood. Some of the covenants, conditions or restrictions may require certain setbacks for installed items, fence heights and types, paint colors, parking rules and much more. By law, the board of directors must enforces this, along with, the other community documents.

Architectural and Design Guidelines (Part 1 of 3)
Design guidelines are regulations that govern the appearance of the community. Guidelines are typically used to create distinctive attractive places, and ensure that present and future development is context sensitive. Design guidelines add value to a community’s built environment by ensuring well-designed buildings, attractive and useful improvements, appealing facades, and cohesiveness. Guidelines can apply to a variety of elements – lighting, signage, basketball hoops, concrete, paint colors, transit shelters, benches, sidewalks, public spaces, parking, etc. The design guidelines are an extension of the CC&R’s.

Design Review Fee Policy
Fee structure for exterior home modifications.

Construction Bond Policy
After the Design Review Committee approves an Owner’s plans and prior to commencing construction activity, a construction bond in the amount of $25,000 shall be delivered to the Association.

Fine Policy
Procedures followed by the Association in attempting to collect fines related to violations of the community documents.

Association Financials

Balance Sheet
The balance sheet is a financial statement that gives an accounting picture of assets owned by the association and of claims against those assets on a specific date. One part of the balance sheet lists assets, while another part shows liabilities and the owner’s equity. ASSETS must always equal LIABILITIES + NET WORTH. Therefore a balance sheet is often described as a “snapshot” of the association’s financial condition at a given point in time.

Income and Expense Report
A financial statement that contains a summary of the Associations’ financial operations for a specific period of time. It shows the net profit or loss for the period by stating the company’s revenues and expenses.

Board of Directors Meeting Minutes and Information
The general meeting of the Mirabel HOA Board of Directors is held in the clubhouse private dining room on the third (3rd) Monday of each month at 8:00 a.m.

After May, the meetings are held in the sales office at the same time and day.
